The following Privacy Policy, including information about the processing of personal data in accordance with Art. 13, 14 GDPR, is provided by Agemo Education GmbH, Innungstraße 15f, 50354 Hürth, represented by Christina Vaiopoulou and Leandra Schmidt (hereinafter “Agemo”). It explains which data we collect about you, what we need this data for, and to whom we pass this data on. Additionally, it includes your rights regarding your data and the contacts to whom you can turn for more information or requests.

1. Definitions

The Privacy Policy of Agemo is based on the terminology used by the European legislator for the adoption of the General Data Protection Regulation (GDPR). Our Privacy Policy should be easy to read and understand for both the public and our customers and business partners. To ensure this, we would like to first explain the terminology used.

In this Privacy Policy, we use, among other terms, the following:

Personal Data: Personal data means any information relating to an identified or identifiable natural person (hereinafter “data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Data Subject: Data subject is any identified or identifiable natural person whose personal data is processed by the controller responsible for the processing.

Processing: Processing is any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.

Restriction of Processing: Restriction of processing is the marking of stored personal data with the aim of limiting their processing in the future.

Profiling: Profiling is any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location, or movements.

Pseudonymisation: Pseudonymisation is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

Controller or Controller Responsible for the Processing: Controller or controller responsible for the processing is the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

Processor: Processor is a natural or legal person, public authority, agency, or other body which processes personal data on behalf of the controller.

Recipient: Recipient is a natural or legal person, public authority, agency, or other body to whom personal data are disclosed, whether a third party or not. However, authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients.

Third Party: Third party is a natural or legal person, public authority, agency, or body other than the data subject, controller, processor, and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

Consent: Consent is any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

2. Data Collection

The website of Agemo collects a series of general data and information with each visit by a data subject or automated system. These general data and information are stored in the server log files. The following data can be collected:

 

  1. Types and versions of browsers used

  2. The operating system used by the accessing system

  3. The website from which an accessing system reaches our website (so-called referrers)

  4. The sub-web pages accessed via an accessing system on our website

  5. The date and time of access to the website

  6. An Internet Protocol address (IP address)

  7. The Internet service provider of the accessing system

  8. Other similar data and information that serve to avert threats in the event of attacks on our information technology systems.

 

Agemo does not draw conclusions about the data subject when using these general data and information. Rather, this information is needed to:

 

  1. Deliver the content of our website correctly

  2. Optimize the content of our website and its advertising

  3. Ensure the continued functioning of our information technology systems and the technology of our website

  4. Provide law enforcement authorities with the information necessary for prosecution in the event of a cyber attack.

 

These anonymously collected data and information are evaluated by Agemo for statistical purposes and also with the aim of enhancing data protection and security within our company, ultimately ensuring an optimal level of protection for the personal data we process. The anonymous data from server log files are stored separately from any personal data provided by individuals.

3. Legal or contractual provisions for the provision of personal data; necessity for the conclusion of a contract; obligation of the data subject to provide personal data; possible consequences of non-provision

We inform you that the provision of personal data is partly required by law (e.g., tax regulations) or may also result from contractual provisions (e.g., details about the contractual partner). At times, it may be necessary to provide personal data to us in order to conclude a contract with us, which subsequently must be processed by us. For instance, the data subject is obligated to provide us with personal data when our company enters into a contract with them. Failure to provide personal data would result in the contract with the data subject not being able to be concluded. Before providing personal data, the data subject must contact our Data Protection Officer. Our Data Protection Officer will inform the data subject on a case-by-case basis whether the provision of personal data is legally or contractually required, or necessary for the conclusion of a contract, whether there is an obligation to provide the personal data, and what the consequences of not providing the personal data would be.

4. Contact possibility via the website

The Agemo website contains information, due to legal requirements, that enables quick electronic contact with our company and direct communication with us, which also includes a general address of electronic mail (email address). If a data subject contacts the data controller via email or a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the data controller is stored for the purpose of processing or contacting the data subject. There is no disclosure of this personal data to third parties.

5. SSL encryption

To protect the security of your data during transmission, we use state-of-the-art encryption methods (e.g., SSL) via HTTPS.

6. Use of cookies

To make visiting our website attractive and to enable the use of certain functions, we use cookies on various pages. These are small text files that are stored on your device. Some of the cookies we use are deleted at the end of the browser session, i.e., after you close your browser (session cookies). Other cookies remain on your device and enable us to recognise your browser on your next visit (persistent cookies). You can set your browser so that you are informed about the setting of cookies and can decide on a case-by-case basis whether to accept them or to exclude the acceptance of cookies for certain cases or in general.

7. Use of Google (Universal) Analytics for web analysis

This website uses Google (Universal) Analytics, a web analytics service provided by Google Inc. Google (Universal) Analytics uses methods that enable an analysis of your use of the website, such as “cookies,” which are text files stored on your computer. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. By activating IP anonymisation on this website, your IP address will be truncated within the member states of the European Union or other parties to the Agreement on the European Economic Area before transmission. Only in exceptional cases will the full IP address be sent to a Google server in the USA and truncated there. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

8. Use of script libraries (Google Webfonts)

To display our content correctly and graphically appealing across browsers, we use script libraries and font libraries such as Google Webfonts. Google Webfonts are transferred to your browser’s cache to avoid multiple loading if your browser supports or allows access to Google Webfonts. If your browser does not support Google Webfonts or prevents access, content will be displayed in a default font.

Calling script libraries or font libraries automatically triggers a connection to the operator of the library. It is theoretically possible that operators of such libraries may collect data.

9. Use of Google Maps

This website uses the Google Maps API to visually display geographic information. When using Google Maps, Google also collects, processes, and uses data about the use of map functions by visitors.

10. Google AdWords

Our website uses Google Conversion Tracking. If you accessed our website through an ad placed by Google, Google AdWords will set a cookie on your computer. These cookies expire after 30 days and are not used for personal identification.

11. Embedded Videos and Images from External Websites

Some of our pages contain embedded content from YouTube or Instagram. When you visit a page from our website that includes embedded videos or images from our YouTube and/or Instagram channels, no personal data, except for the IP address, is transmitted.

12. Changes to our Privacy Policy and Notification of Changes

Changes in laws or changes in our internal processes may require adjustments to this privacy policy. We reserve the right to occasionally adjust this privacy policy to ensure that it always complies with current legal requirements or to implement changes in our services in the privacy policy.

13. Updating/Deleting Your Personal Data

You have the option at any time to review, modify, or delete the personal data provided to us by sending us an email to: info@agemoglobal.com. You can also opt out of receiving further information in the future.

14. Rights of the Data Subject

Every data subject has the rights granted by the GDPR, including the right to confirmation, access, rectification, erasure, restriction of processing, data portability, objection, and withdrawal of consent.

15. Legal basis for processing

Art. 6(1)(a) GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. Other legal bases may include contract performance, legal obligations, vital interests, or legitimate interests.

16. Legitimate interests in processing pursued by the controller or a third party

If the processing of personal data is based on Art. 6(1)(f) GDPR, our legitimate interest is the conduct of our business activities for the benefit of the well-being of all our employees and our shareholder.
